Collision with Pharmacy Glass Facade – €15,000 Compensation for Customer

Summary
In an unfortunate incident outside a pharmacy in Limassol, a customer sustained serious injuries after colliding with an invisible glass wall due to lack of signage and safety measures. The case highlighted negligence by shop owners regarding customer safety. The client received €15,000 in compensation for the injuries and suffering caused.
The Incident
On November 16, 2023, 47-year-old a civilian from Limassol visited a pharmacy in the Pyrgos area. While attempting to enter the premises, he collided with a nearly invisible glass surface forming part of the store’s facade. The impact was severe, causing injuries to the client in two places.
He was immediately transferred to the ER of the Mediterranean Hospital, where he was diagnosed with:
- A fracture of the right big toe by an Orthopaedic Surgeon
- A nasal bone fracture with deformation and breathing difficulty, was also diagnosed
As a result, the client underwent corrective surgery under general anesthesia on November 23, 2023.
Recovery required 36 days of medical leave and continuous medication.
Legal Approach
Our office issued a Letter of Claim to the pharmacy, citing:
- Non-compliance with the Roads and Buildings Regulations (Regulation 61HA(5), K.D.P. 262/2018)
- Disregard of the ETEK Building Code on glass safety measures
The owner’s failure to properly mark or make visible the glass surface and use appropriate safety glass led directly to the accident.
The Outcome
Following legal negotiations with the insurance company providing insurance coverage to the above mentioned pharmacy, a compensation of €15,000 was secured for the client for physical injury, pain, and emotional distress.
